
What is Power of Attorney (POA)?
A Power of Attorney is a legal document that authorizes another person to act on your behalf in specified matters. In Dubai real estate, a POA is commonly used when a property owner cannot be physically present to sign documents, complete a sale, manage a rental, or handle administrative procedures at the Dubai Land Department (DLD).
How Power of Attorney Works in the UAE
There are two main types of POA used in Dubai property transactions:
- General Power of Attorney: Grants broad authority to act on your behalf across multiple matters. Less common in real estate due to the risks involved.
- Special (Specific) Power of Attorney: Limits authority to defined actions — such as selling a specific property, signing a tenancy contract, or collecting rent. This is the preferred form for property transactions.
To be valid in Dubai, a POA must be:
- Notarized by a Notary Public at a Dubai court or, if issued abroad, authenticated by the UAE Embassy in the issuing country and then attested by the UAE Ministry of Foreign Affairs (MOFA).
- Translated into Arabic by a certified legal translator if originally in another language.
- Registered and stamped with the appropriate court or notary authority.
Practical Example
You own an apartment in Dubai but live in London. You need to sell the property, but you cannot travel for the DLD transfer. You visit the UAE Embassy in London, present your passport and Title Deed copy, and issue a Special POA authorizing your brother in Dubai to sell the specific unit at a price not below AED 1.5 million. The POA is attested by the embassy, then by MOFA in Dubai. Your brother can now complete the entire sale — from signing the MOU to attending the trustee office — on your behalf.
